You may be asked for your W-2. Your employer has the right to know how much you were being paid for your previous work. Therefore, they can ask for your W-2. However, this will still be upon your discretion. The only factor here is that they can refuse to hire you legally if you decide not to give it when they ask.

You may be asked about your criminal record. For the safety of your employer, they have the right to know whether you were convicted for a specific case. This is to let the employer know if your record and history can go well with the job. At this point, they are given the freedom to use this in making a decision on whether to hire you or not.

You may be asked about drug consumption or history. Employers are given the right to ask for a drug testing. This is because they are to protect life, health and property of the entire company. This lets them know if you are safe and capable of operating normally at work.
